2. Legal Status of PayHot

PayHot is a software and technology platform for integrating payment methods, managing projects, transmitting payment requests, receiving statuses, monitoring, analytics, anti-fraud controls, and technical support.

The Operator is not a bank, credit institution, bank card issuer, payment system operator, or direct acquirer unless otherwise expressly provided by a separate agreement and the relevant licence.

All settlements are performed by Partner Providers. PayHot does not replace a bank or payment institution and does not guarantee that a specific financial method will be available without approval from the relevant Partner.

3. Partner Settlement Model

Transactions are performed directly by independent banks, acquirers, payment institutions, money transfer operators, bulk payout systems, cryptocurrency processors, and other Partners. Depending on the transaction, a Partner may:

  • identify and verify the User;
  • decide whether to authorise or decline a transaction;
  • set fees, limits, reserves, and settlement periods;
  • process payment instrument details;
  • process refunds, chargebacks, and bulk payouts;
  • convert and transfer funds;
  • perform AML, sanctions, and anti-fraud checks.

PayHot provides the technical connection, interfaces, and support, but does not control every internal process of an independent Partner.

4. Available Services

Following review and subject to the availability of Partner infrastructure, a Project may be able to use:

  • payments through the Faster Payments System using a QR code;
  • Mir, Visa, Mastercard, and Maestro cards issued by Russian banks;
  • international e-commerce and foreign bank cards;
  • payments through the ERIP system of the Republic of Belarus;
  • recurring payments;
  • bulk payouts to cards, through the Faster Payments System, and by other available methods;
  • payments in supported cryptocurrencies;
  • payouts and settlements in available currencies and digital assets.

The exact list is determined individually. Mentioning a method on the Website is not a public guarantee that any Project will be connected to it.

5. Relationship with the Merchant and Payer

The Merchant is the seller of goods or provider of services and is solely responsible for the legality of its offer, quality, fulfilment, receipts, taxes, refunds, and communication with customers.

PayHot is not a party to the sale or service agreement between the Merchant and the Payer. Questions concerning goods, delivery, subscriptions, and refunds must initially be addressed by the Payer to the Merchant.

6. Review and Restrictions

PayHot may review a Project, its traffic sources, owners, payment scenario, and other risks. Connection may be declined, restricted, or suspended following a review or at the request of a Partner or competent authority.

The Platform may not be used for unlawful activities, fraud, money laundering, sanctions evasion, sham transactions, the sale of prohibited goods, or other activities that create an unacceptable risk.

7. Personal Data and Security

Personal data processing is described in the Privacy Policy, the use of cookies in the Cookie Policy, and financial monitoring measures in the AML/KYC Policy. PayHot performs anti-fraud analysis, Project screening, and AML analysis of cryptocurrency wallets within its role and based on the data available to it.

8. Intellectual Property

The PayHot trade name, software interfaces, design, texts, documentation, and other materials are protected by law. The brand or materials may be used only with the rights holder's permission or to the extent expressly permitted by law.

9. Governing Law and Enquiries

The Operator's activities are governed by the laws of the Federative Republic of Brazil. The laws of the User's, Merchant's, and Partner Provider's countries may also apply to particular transactions.

Legal and general enquiries may be sent to team@pay.hot. The request should include the sender's name, contact details, Project, transaction identifier, and a description of the issue. Do not send full bank card details, passwords, seed phrases, or private keys by email.
